Article 1 – General Provisions

1.1 – Scope of Application

These Terms and Conditions of Sale (“T&Cs”) apply to all orders placed by a consumer (“the Customer”) with Agathe Sorlet Company via the website agathesorletshop.com (“the Site”).

The sales offer presented on the Site:

• is intended exclusively for individuals acting as consumers, i.e. natural persons purchasing for personal, non-professional purposes;
  
  
• applies to deliveries in France, within the European Union, and in multiple international destinations, depending on the areas covered by our carriers. Some destinations may be temporarily unavailable due to logistical or regulatory constraints.
  
  

By placing an order on agathesorletshop.com, the Customer confirms that they meet these conditions and are not purchasing products for resale or business purposes.

 

1.2 – Acceptance of the Terms and Conditions

All product sales carried out on agathesorletshop.com are governed solely by these T&Cs.

Placing an order implies full and unconditional acceptance of the T&Cs, which prevail over any other document. The Customer declares that they have read and accepted the T&Cs before confirming their order.

The applicable T&Cs are those in force at the date of the order. The Customer may download or save a copy of the T&Cs at any time.

Failure by the Seller to enforce any clause at a specific time shall not constitute a waiver of its right to do so later. If any clause of these T&Cs is deemed invalid, the remaining clauses shall remain in effect.

 

Article 2 – Description of Products

agathesorletshop.com is an online store offering artworks and related products: illustrations, prints, textiles, and accessories (hereinafter the “Products”).

Product descriptions and photos are provided for informational purposes and are not contractual. Products comply with applicable French and EU regulations.

The Customer is responsible for their Internet access and equipment. The Seller cannot be held liable for technical issues or configuration errors on the Customer’s part.

Article 3 – Customer Identification

To place an order, the Customer must identify themselves by creating an account on agathesorletshop.com.

3.1 – Account Creation

The Customer may create a personal account by completing the registration form. Access requires a personal username and password, which must remain confidential.

The Customer agrees to provide accurate, up-to-date information and to maintain it. They also agree not to provide false or unauthorized information.

In the event of fraudulent use or data theft, the Customer must notify the Seller immediately. The Seller reserves the right to suspend or delete any account that violates these terms.

Article 4 – Orders

The Seller strives to maintain optimal product availability. Prices and offers shown on the Site remain valid while visible and in stock.

If a Product becomes unavailable after an order, the Seller will notify the Customer and offer either:

• delivery of an equivalent Product, or
  
  
• a refund within 30 days.
  
  

Order Process

To order, the Customer must:

1. Select Products and add them to their cart.
   
   
2. Review the order summary and total price.
   
   
3. Accept the T&Cs by checking the appropriate box.
   
   
4. Confirm payment by clicking “Place Order / Pay”.
   
   

Once payment is validated, the Seller will send a confirmation email summarizing the order and applicable T&Cs.

The Seller recommends saving or printing this email as proof of purchase.

Orders become final once full payment is received. The Seller may refuse any order for legitimate reasons, such as:

• non-compliance with T&Cs,
  
  
• outstanding disputes or unpaid invoices,
  
  
• abnormal order volume,
  
  
• or banking authorization failure.
  
  

The Customer is responsible for the accuracy of their delivery information. The Seller cannot be held liable for delays or failed deliveries due to address errors.

Article 5 – Prices, Payment, and Security

5.1 – Prices

Prices are listed in euros (€) and include all French and EU taxes (VAT).

They do not include delivery fees, customs duties, or import taxes that may apply outside the EU (e.g., Switzerland, UK, USA, Canada).

Applicable delivery fees are displayed before checkout. The total price (excluding external customs costs) appears on the order confirmation page.

5.2 – Payment

All payments are made online, in full.

Accepted payment methods include:

• Credit cards: Visa, Mastercard, American Express, JCB, Discover, Diners Club
  
  
• Digital wallets: Apple Pay, Google Pay
  
  
• Third-party wallets: PayPal
  
  

Payments are securely processed through Shopify Payments (powered by Stripe) or PayPal, with SSL encryption ensuring that banking data never transits through the Site.

The Seller reserves the right to request verification documents before confirming an order.

Article 6 – Retention of Ownership

Products remain the exclusive property of Agathe Sorlet Company until full payment is received.

Risk of loss or damage transfers to the Customer upon delivery.

Article 7 – Shipping and Delivery

Delivery means the transfer of physical possession of the Product to the Customer.

Delivery Methods

Depending on destination, shipments are handled by:

• France: Colissimo (home delivery) and Mondial Relay (pickup point).
  
  
• European Union: Colissimo International, Delivengo, or partner relay networks.
  
  
• Other countries: Colissimo International, DHL Express, or equivalent carriers.
  
  

Shipping Times

Orders are prepared and shipped within 48 business hours (excluding weekends and holidays), subject to stock availability.

Custom or pre-order items require additional processing time indicated on the product page.

Estimated Delivery Times

• France: 2–4 business days
  
  
• Europe: 3–6 business days
  
  
• Rest of the world: Variable, depending on the carrier
  
  

In exceptional circumstances (strikes, peak periods, or customs delays), delivery may take longer.

Responsibility

The Seller is responsible for timely shipment but not for third-party carrier delays.

If a parcel is lost, a replacement or refund will be issued after 30 calendar days from shipment.

Upon Delivery

The Customer must inspect the parcel before signing for it.

• If damaged: refuse the delivery immediately for faster processing.
  
  
• If accepted with visible damage: contact the Seller promptly with photos of the item, packaging, and shipping label.
  
  

 

Article 8 – Right of Withdrawal

8.1 – Legal Withdrawal

Under EU law, Customers have 14 days from delivery to withdraw without justification.

Requests can be made via:

Customers then have 14 additional days to return the Products.

8.2 – Exclusions

The right of withdrawal does not apply to:

• personalized Products,
  
  
• digital files delivered immediately after purchase.
  
  

8.3 – Returns

Returns must be sent in their original packaging and condition to:

Return costs are the Customer’s responsibility, unless the Seller is at fault.

8.4 – Refunds

Refunds are issued within 14 days of receipt of the returned Product, using the original payment method.

Initial shipping fees are non-refundable.

Article 10 – Intellectual Property

10.1 – Website Content

All elements of the Site (texts, images, videos, logos, drawings, designs, software, trademarks, etc.) are the exclusive property of Agathe Sorlet Company and protected under French and international intellectual property laws.

No element of the Site may be reproduced, distributed, modified, or reused in any way without prior written authorization.

10.2 – Product Designs

Products sold on the Site — including prints, illustrations, and original artworks — are protected by copyright.

Purchasing a Product grants ownership of the physical item only, not its intellectual property rights.

Any reproduction, modification, or commercial use of Agathe Sorlet’s artwork without written consent is strictly prohibited and may constitute infringement under Articles L.335-2 and following of the French Intellectual Property Code.
